JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 29-11-2024 Heard learned counsel for the petitioner, learned A.P.P. for the State and learned senior counsel for informant.
2. The petitioner seeks bail in a case registered for offence under Section 420 of the Indian Penal Code and Section 138 of the N.I.Act.
3. It is alleged that this petitioner issued cheque of Rs. 30 lacs, which got dishonoured due to insufficient fund.
4. Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in this case. The petitioner did not issue any cheque to the informant. As a matter of fact, husband of petitioner used to work in the office of informant and has been discharging his duty at the instance of informant, but informant made allegation against petitioner's husband that he withdrew huge amount from the account of company. Patna High Court CR. MISC. No.36221 of 2024(4) dt.29-11-2024 2/2 granted bail. Petitioner is lady and is in custody since 05.02.2024.
5. Learned senior counsel Sri Krishna Prasad Singh appearing on behalf of informant vehemently opposes the bail petition.
6. However, considering the period of custody and the fact that petitioner is lady, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate - 9, Patna in connection with Shastri Nagar P.S. Case No. 737 of 2019 (G.R. No. 7578 of 2019).
