The petitioner apprehends his arrest in connection with Mohania P.S. Case no. 378 of 2018 registered under Sections 379, 411, 467, 468 and 34 of the Indian Penal Code. The stolen motorcycle is said to have been recovered from the possession of Priyanshu Singh and Rakesh Pandey @ Bishal. The said Rakesh Pandey @ Bishal divulged the name of the petitioner from whom he had borrowed the said motorcycle.

Learned counsel for the petitioner submitted that no such occurrence as alleged ever took place. The petitioner is quite innocent and has been falsely implicated in this case.

No.62930 of 2018(2) dt.14-12-2018 2/2 There is nothing on record indicating the complicity of the petitioner in the occurrence barring the confessional statement of Rakesh Pandey @ Bishal made due to animosity. Petitioner was not apprehended on the spot with the stolen motorcycle. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-VI, Kaimur at Bhabua in connection with Mohania P.S. Case No. 378 of 2018, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Prakash Chandra Jaiswal, J) Trivedi/- U T
