This application for anticipatory bail arises out of Sarai P.S. Case No. 143 of 2017 for the offence punishable under Sections 147, 148, 149, 341, 353, 427, 337, 283 and 504 of the Indian Penal Code and Section 3/4 of Essential Service Maintenance Act.
It appears from the First Information Report that a
Patna High Court CR. MISC. No.31247 of 2019(2) dt.10-05-2019 2/3 lot of people were protesting against the administration and were demanding compensation to the dependents of deceased, who had died in a road accident. In the said course, several persons, named in the First Information Report, and 300 persons unknown, had blocked the road and on intervention of police, they indulged in vandalizing and damaging the police vehicle. Learned counsel appearing on behalf of the petitioners has submitted that the allegation is general and omnibus.
This application is, therefore, allowed.
Let the petitioners above named, in the event of their arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-XIIIcum-Sub Judge-XIV, Vaishali at Hajipur, in Sarai P.S. Case No. 143 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions,
