ABHISHEK REDDY ORAL ORDER 18-04-2024 Learned counsel for the petitioner has stated that without serving the copy of the show cause notice or giving an opportunity of hearing to the petitioner, the PDS license of the petitioner has been cancelled in the month of February, 2023. Learned counsel seeks permission of this Court to withdraw the present writ petition with a leave to avail the alternative remedy of approaching the District Magistrate by way of statutory appeal.
2. Having regard to the same, the present writ petition is permitted to be withdrawn granting the aforesaid liberty. As the matter has being pending before this Court, the appellate authority shall entertain the appeal filed by the petitioner
Patna High Court CWJC No.8295 of 2023(7) dt.18-04-2024 2/2 without adverting to the period of limitation. The appeal shall be dealt with in accordance with law. The entire exercise shall be completed as expeditiously as possible preferably within a period of eight weeks from the date of filing of the appeal by the petitioner. Any order passed shall be communicated to the parties. The petitioner shall be given an opportunity of hearing.
3. The present C.W.J.C. is accordingly disposed of as withdrawn.
