The petitioners seek pre-arrest bail in connection with Choutham P.S.Case No. 135 of 2018 registered under Sections 341, 323, 504, 498(A), 354(B) & 34 of the Indian Penal Code. It is submitted that there is no truth behind the allegation made in the FIR that the petitioners in any manner subjected the informant to cruelty for non fulfillment of demand of dowry. It is contended that the petitioners are mother-in-law and unmarried sister-in-law respectively and the allegation in the FIR is mainly against the husband and the father-in-law. Learned counsel for the State opposed the application for grant of pre-arrest bail of the petitioners.
Patna High Court Cr.Misc. No.67279 of 2018(2) dt.17-12-2018 2/2 Considering the nature of allegation and the submissions made above, in the event of arrest or surrender before the court below within four weeks from today, the petitioners are directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Khagaria in connection with Choutham P.S. Case No. 135 of 2018 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
