JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-12-2018 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Bihta P. S. case no. 473/2018 registered under sections 341, 323, 504, 379/34 of the IPC and 27 of the Arms Act. All sections are bailable in nature except section 379 IPC and 27 of the Arms Act.

So far as section 27 of the Arms Act is concerned, informant claims that the petitioner made firing in air and so far as section 379 IPC is concerned, the same appears to be superfluous in nature. The petitioner does not have any criminal antecedent.

Considering the aforesaid facts and circumstances as

No.67384 of 2018(2) dt.04-12-2018 2/2 well as submissions of the parties, in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate I, Danapur in Bihta P. S. case no. 473/2018 subject to condition as laid down under section 438(2) of the Cr.P.C.
