JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 03-12-2020 In view of the submission and the undertaking of the learned counsel for the petitioner, at the time of hearing of this application through video conferencing, that he would remove the defect(s), as pointed out by the office vide its notes dated 24.11.2020, within two weeks of starting of the Court proceeding in physical mode, he is permitted to remove the same accordingly.
Heard learned counsel for the petitioner and the learned A.P.P. for the State through video conferencing. The petitioner seeks bail in connection with Turkauliya P.S. Case No. 14 of 2020, registered under Sections 401, 413 and 414 of the Indian Penal Code.
The accusation is that on receiving secret information about movement of three miscreants on

No.31697 of 2020(2) dt.03-12-2020 2/3 motorcycle, without registration number, to commit offence, the informant along with other Police personnel reached at the road connecting to Bijulpur and Baxaba, then three persons were seen coming on motorcycle. When signal was given to stop the motorcycle then they tried to flee away turning the motorcycle, but, on chase, they were apprehended. The person, who was driving the motorcycle disclosed his name Md. Neyaz Alam @ Tigar and other two persons disclosed their names Mansoor Alam and Tapesh Manjhi. On search, petitioner was found in possession of knife and all of them disclosed that they have committed theft of the seized motorcycle.
Learned counsel appearing for the petitioner submits that, in fact, the petitioner was passing through the road, in the meantime, two miscreants started fleeing and they were apprehend by the Police. Further submission is that, in fact, petitioner is accused in three cases, as detailed in paragraph-3, due to that reasons, the Police remanded the petitioner in the present case on 08.01.2020. On investigation, the Police has submitted Chargesheet. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be

No.31697 of 2020(2) dt.03-12-2020 3/3 released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Turkauliya P.S. Case No. 14 of 2020. One surety must be parents/close relative of the petitioner.
