This application for anticipatory bail arises out of Dhanha P.S. Case No. 149 of 2013 for the offence punishable under Sections 420, 465 and 471 of the Indian Penal Code. The petitioner was made accused in the above case, registered in 2013. This application has been filed in 2019 seeking anticipatory bail.
Learned counsel appearing on behalf of the petitioner has submitted that because of the serious nature of ailment, which the petitioner is suffering from, she could not approach this Court for grant of anticipatory bail immediately after First Information Report was lodged. The allegation is of securing appointment as Auxiliary Nurse and Midwife on forged and fabricated document.
Learned counsel appearing on behalf of the
Patna High Court CR. MISC. No.31254 of 2019(2) dt.10-05-2019 2/2 petitioner states that she had submitted her resignation in 2013 itself.
Considering the facts and circumstances, this application is allowed.
Let the petitioner above named, in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-1st, Bagaha, in Dhanha P.S. Case No. 149 of 2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present herself before the Police/Court, as the case may be, as and when required and in the event of failure on her part to appear before the Court on two consecutive occasions, her bail bonds shall be liable to be cancelled.
