The petitioner is apprehending his arrest in a case registered for the offence punishable under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that there is no recovery from the conscious possession of the petitioner, but para 3 of the bail petition it is mentioned that the petitioner has an accused in Pandarak P.S. Case No. 113/2018 and Mokama P.S. Case No. 162 of 2017 under Section 30 (a) of the Excise Act.

In the aforesaid facts and circumstances, I am not inclined to enlarge the petitioner on bail. Accordingly, the prayer

Patna High Court CR. MISC. No. 36071 of 2019(3) dt.13-08-2019 2/2 for bail of the petitioner is rejected in connection with Hathidah P.S. Case No. 82/2018 from the Court of learned Special Judge, Excise, Patna.

Accordingly, the application is dismissed.
