The appellant is aggrieved by the order dated 03.09.2020 passed by the Additional Sessions Judge, 1st-cumSpecial Judge SC/ST Court, Saran at Chapra in Chapra Town P.S. Case No. 514 of 2019 registered for the offences under Sections 147,148,149,323,324,307,302,436 IPC, 23(1)(r)(2) (iv) (v) of the SC/ST ActAct, whereby regular bail petition of the appellant has been rejected.
It is alleged that the brother of the informant was assaulted with Lathi, Danda and as a result of which the brother of the informant succumbed to the injuries.
Learned counsel for the appellant submits that the appellant has no criminal antecedent. The appellant is whole
Patna High Court CR. APP (SJ) No.1899 of 2020(3) dt.12-01-2021 2/2 seller of Milk. It is alleged that appellant was simply at the door of the informant. He further submits that the appellant surrendered on 24.7.2020. The other co-accused have been granted bail vide Annexure-2.
Considering the aforesaid, the Court is inclined to grant bail to the appellant on deposit of cash of Rs. 25,000/-. Let the appellant, above named, be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the 1st Additional Sessions Judge-cum- Special Judge, SC/ST Act, Saran at Chapra in connection with Chapra Town P.S. Case No. 514 of 2019, subject to deposit of cash of Rs. 25,000/-. The deposit of Rs. 25,000/- cash shall abide by the final out come of the present criminal case.
