JUSTICE PARTHA SARTHY ORAL ORDER 03-12-2020 Heard learned senior counsel for the petitioner and learned APP for the State, through video conferencing. The petitioner has filed the instant application for grant of regular bail in connection with Taraiya P.S. Case No. 84 of 2019 registered for the offence under sections 302, 147, 148, 149, 307, 341, 323 and 504 of the Indian Penal Code. As per allegation in the FIR, the petitioner and two other persons are stated to have assaulted the brothers of the informant with iron rod and lathi.

It is submitted by learned senior counsel appearing for the petitioner that the earlier application for bail of the petitioner was rejected vide order dated 20.11.2019 (Annexure1) passed in Cr. Misc. No. 73768 of 2019, however giving liberty to the petitioner to renew his prayer for bail after six

Patna High Court CR. MISC. No.15087 of 2020(5) dt.01-12-2020 2/2 months. It is submitted that more than one year has passed since passing of the said order and the petitioner is in custody since 24.3.2019.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the submissions made on behalf of the petitioner together with the petitioner being in custody since 24.3.2019 and the liberty granted by the aforesaid order dated 20.11.2019, the Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with S.Tr. No. 447 of 2019 (arising out of Taraiya P.S. Case No. 84 of 2019) on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the Additional District and Sessions Judge-V, Saran at Chapra.
