Mr.Rajendra Prasad Nat ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 23-05-2019 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Gurua P.S. Case no. 227 of 2018, registered under Sections 147, 148, 149, 341, 342, 323, 332, 333, 337, 338, 307, 188, 427, 353, 504 and 506 of the Indian Penal Code. The accusation is that on 09.11.2018 at about 10.00 A.M. procession was going on to immerse the idol of goddess Laxmi, when procession reached near the house of Dular Chand Yadav and Krishna Ravidas, the persons named in the F.I.R. and some unknown, including the petitioners, belonging to Muslim community came there and started pelting stones in which informant and other Police personnel sustained injuries. Learned counsel for the petitioners submits that while petitioners are named in the F.I.R., but no specific overt act has been attributed against the petitioners. Further submission is that similarly situated Arshad Hussain and 11 others have already been granted privilege of pre-arrest bail by a co-ordinate Bench of this Court on 08.05.2019 vide Criminal

Patna High Court CR. MISC. No.33920 of 2019(2) dt.23-05-2019 3/3 Miscellaneous No. 30236 of 2019. The petitioners have no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the S.D.J.M. Sherghati in connection with Gurua P.S. Case No. 227 of 2018, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
