2. The petitioner has preferred this application for grant of regular bail in connection with Jehanabad Town P.S. Case No. 426 of 2023, dated 09.05.2023 registered for the offences punishable under Sections 302 and 120B of the Indian Penal Code and under Section 27 of the Arms Act.

3. As per the prosecution case, the FIR named coaccused persons are alleged to have got the informant's husband murdered by an unknown miscreant due to dispute over tender and money.

4. Learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.31079 of 2025(2) dt.16-07-2025 2/3 that the petitioner is innocent and has falsely been implicated in this case. The petitioner is not named in the F.I.R. and name of the petitioner has sprung up in the confessional statement of the co-accused Rahul Kumar and except the confessional statement of the co-accused person, no cogent material has come during investigation which suggests the involvement of the petitioner in the present occurrence. Nothing has been recovered from the conscious possession of the petitioner. The co-accused Rahul Kumar agaisnt whom there is specific allegation of firing has already been granted bail by this Court vide order dated 04.07.2024 passed in Cr. Misc. No. 39140 of 2024. The petitioner has clean antecedent as stated in paragraph no. 3 of the bail petition. The petitioner is in custody since 22.05.2023.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as petitioner's period of custody, the petitioner, above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of the like amount each to the satisfaction of learned Additional District Judge-X, Jehanabad, in connection with Jehanabad Town P.S. Case No. 426 of

7. The application stands allowed.
