Petitioner seeks regular bail in connection with Shankarpur P.S. Case No. 17/22 registered for the offences punishable under Sections 399, 402 of Indian Penal Code and Sections 25(1-B)a/26/35 of the Arms Act.
As per the prosecution, one loaded country made pistol and three live cartridges were recovered from the possession of this petitioner.
The main submissions advanced by the learned counsel Mr.Amarnath Jha for the petitioner are that as per the allegation made in the FIR, one loaded country made pistol and three live cartridges were alleged to have been recovered from possession of this petitioner and in the present matter, the
Patna High Court CR. MISC. No.32606 of 2022(5) dt.20-02-2023 2/2 investigation has completed and the petitioner has been languishing in jail since 30.01.2022 and there is no material witness of the seizure of the alleged firearm and the petitioner has got bail in two cases out of the six cases of his criminal antecedents.
Learned APP Ms.Rina Sinha appearing for the State has opposed the bail prayer.
Having considered the criminal antecedents of six cases being against the petitioner and the recovery of firearms from his conscious possession, this Court is not inclined to accept the petitioner's bail prayer. Accordingly, his bail prayer stands rejected.
Petitioner may renew his bail prayer after six months. (Shailendra Singh, J) Sanjay/- U T
