The petitioners are apprehending their arrest in connection with Muffasil P.S. Case No. 136 of 2018 for the offence registered under Sections 448, 341, 323, 337, 427, 384, 379, 506 and 34 of the Indian Penal Code.
Learned counsel for the petitioners submits that the entire allegation against the petitioners is false and concocted and there was previous enmity between the parties on account of which the present case has been lodged. It is further submitted that the informant was trying to grab the land of the petitioners and the co-accused and when the co-accused, Mukhiya called the Amin for measurement of land, the prosecution party started
Patna High Court Cr.Misc. No.66059 of 2018(3) dt.19-12-2018 2/2 creating disturbances and have filed the present case to save their own skin and implicated the petitioners in connection with the present case. It is further submitted that a counter case bearing Muffasil P.S. Case No. 138 of 2018 under similar sections has been filed by co-accused Mukesh Singh. It is further submitted that that the petitioners have no criminal antecedents.
Considering the aforesaid facts and circumstances of the case, let the petitioners, above named, in the event of their arrest/surrender before the learned counsel below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nawada in connection with Muffasil P.S. Case No. 136 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Anjana Mishra, J) Jagdish/- U T
