Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
This application for regular bail arises out of Gaya Excise Case No. 120 of 2021, disclosing offence punishable under Sections 30(a) and 56(b) of Bihar Prohibition and Excise Act, 2018.
The petitioner is in custody since 22.03.2021. Allegedly, 135 litres of Indian-made foreign liquor was recovered from a Scorpio vehicle in which the petitioner was also found sitting along with another co-accused.
Patna High Court CR. MISC. No.41805 of 2021(3) dt.06-01-2022 2/2 Learned counsel appearing on behalf of the petitioner has submitted that the co-accused Kunal Mishra has been allowed regular bail by this Court by an order dated 14.09.2021, passed in Cr. Misc. No. 35705 of 2021.
Considering the submission that similarly circumstanced co-accused has been allowed regular bail and the petitioner is in custody since 22.03.2021, this application is allowed.
Let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Excise, Gaya, in Gaya Excise Case No. 120 of 2021.
