2. This is second application for grant of anticipatory bail to the petitioner. Earlier, the prayer for anticipatory bail of petitioner was rejected, vide order dated 12.07.2022 passed in Cr.Misc. No. 21073 of 2021 (Annexure -1).

3. Learned counsel for the petitioner submits that during pendency of the case, due to intervention of common friends, good sense prevailed in between the parties and they have settled their differences and to this effect, have filed a joint compromise petition before the learned Court below incorporating the terms & conditions. A copy of the same has

4. Considering the aforesaid facts and circumstances, the prayer for anticipatory bail of petitioner is allowed. Let the above named petitioner, in the event of arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Bhagalpur in connection with Kahalgaon P.S. Case No. 705 of 2020, subject to condition as laid down under Section 438(2) of the Cr.P.C. with further conditions:

"(i) The petitioner shall abide by the terms & conditions, as mentioned in joint compromise petition at Annexure 4 to the supplementary affidavit.

(ii) If petitioner fails to obey the terms & conditions, as mentioned in joint compromise petition, the Court below is free to cancel the bailbond of the petitioner." (Prabhat Kumar Singh, J) anay U T
