2. The petitioner seeks bail in connection with Ahiyapur P.S. Case No. 369 of 2023 instituted for the offences under Sections 304(B)/34 of the Indian Penal Code and Sections 3/4 of the D.P. Act.
3. As per prosecution case, the accusation has been made against the petitioner of committing murder of the Informant's sister by strangulation due to non-fulfillment of dowry demand. It is alleged that since the time of marriage, the petitioner was demanding a motorcycle.
4. This is the second attempt of the petitioner for bail. The petitioner has renewed his prayer for grant of regular bail
Patna High Court CR. MISC. No.31318 of 2025(3) dt.09-07-2025 2/3 which was earlier rejected on merit by this Court vide order dated 25.09.2024 passed in Cr. Misc. No. 44626 of 2024.
5. In compliance of the order dated 09.05,2025, a report dated 27.05.2025 with regard to the present stage of trial has been received, which has been kept at Flag- 'R'.

From perusal of the aforesaid report dated 09.05.2025 sent by the learned Additional Sessions Judge-12th, Muzaffarpur, it appears that four non-official witnesses including the informant have been examined on behalf of the prosecution and the case is at the stage of prosecution evidence. It is further stated that four witnesses, including the I.O. and the Doctor, are yet to be examined and the next date is fixed on 30.05.2025 for adducing evidence on behalf of the prosecution.
7. Learned counsel for the petitioner submits that the petitioner is the husband of the deceased and is languishing in judicial custody since 09.03.2024 without any rhymes or reason.
8. There is no new ground to consider the bail petition of the petitioner. From the aforesaid report, it appears that the trial is going on and is at an advance stage.
9. In view of the above, the prayer for bail of the petitioner is again rejected with a direction to the court below to expedite the trial and conclude the same expeditiously
Patna High Court CR. MISC. No.31318 of 2025(3) dt.09-07-2025 3/3 preferably within a period of four months from today. If the trial is not concluded within the period of four months, as stated above, the petitioner will be at liberty to renew his prayer before the court below.
