JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-12-2020 The office has pointed out several defects to which learned counsel of the petitioner assures that he shall remove the defects within four weeks from the date when the court starts physical function.

Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners are in jail custody since 31.05.2020 in a case registered for the offences punishable under Sections 30(a) of Bihar Prohibition & Excise Act and Section 25 (1-B) a, 26,35 of the Arms Act.

Petitioners were caught and about 230 liters liquor were recovered and one country made loaded pistol was also

Submission on behalf of the petitioners is that they were caught on mere suspicion and as a matter of fact, nothing was recovered from their conscious possession. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners, above named, be released on provisional bail till removal of the defects on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II, cum Special Judge, Excise Samastipur in connection with Bithan P.S. Case No. 56 of 2020. It is made clear that if the defects, as pointed out by the office are removed within the above stated period , the provisional bail of the petitioner shall be deemed to be confirmed.
