Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual mode.
The petitioner seeks regular bail in connection with Sonepur P.S. Case No. 159 of 2022 lodged under Sections 341, 323, 307, 353, 414, 427, 324, 325 of the I.P.C. read with Section 30(a) of the Bihar Prohibition and Excise Act. As per the prosecution case, total recovery of 50 litres desi wine is subject matter of this case from 2 cars. Learned counsel for the petitioner submits that the said recovery has not been made from conscious possession of the petitioner. Patna High Court CR. MISC. No.32658 of 2022(3) dt.11-11-2022 2/2 for the petitioner further submits that he is neither driver nor owner or khalasi of the said vehicle. Learned counsel further submits that he was apprehended under wrong impression. Learned counsel further submits that antecedent of the petitioner is clean and he is in custody since 05.03.2022. Learned counsel for the State opposes the prayer for bail.
In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Exclusive Special Judge, Excise, Saran at Chapra in connection with Sonepur P.S. Case No. 159 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C.
With this observation, the bail application stands allowed.
