====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 08-08-2024 Heard learned counsel for the petitioners, learned A.P.P. for the State and learned counsel for the Opposite Party No. 2.
2. The petitioners apprehend their arrest in connection with T.R. No. 1091 of 2023 arising out of C.R. No. 503 of 2023 P.S. Case No. 246 of 2024 registered under Sections 323, 420, 406, 504 and 506 of the Indian Penal Code.
3. As per the complaint case, all the accused persons
Patna High Court CR. MISC. No.37203 of 2024(5) dt.08-08-2024 2/3 including these petitioners under conspiracy got executed sale deed from the mother of complainant. It is further alleged that the land in question is purchased land in the name of father of complainant.
4. Learned counsel appearing on behalf of the petitioners submits that petitioners are innocent and have falsely been implicated in the present case due to personal grudge. Further submission is that the dispute involved in this complaint case is purely civil in nature. As a matter of fact, the mother of complainant had executed sale deed in respect of a land which was given to the mother of petitioner nos. 1 and 2 as her share during life time of their father. Petitioners have got clean antecedent.

Learned A.P.P. appearing on behalf of the State and learned counsel for the Opposite Party No. 2. opposed the bail application and submits that these petitioners and named accused persons under conspiracy got executed sale deed from the mother of complainant which was the purchased land of father of complainant.
6. Having considered the nature of dispute and the rival submissions advanced on behalf of the parties, let the above named petitioners be released on bail, in the event of arrest or

No.37203 of 2024(5) dt.08-08-2024 3/3 surrender before the learned court below within a period of six weeks from today, on furnishing bail-bonds of Rs. 10,000 (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate-I, Rosera, Samastipur in connection with T.R. No. 1091 of 2023 arising out of C.R. No. 503 of 2023 P.S. Case No. 246 of 2024, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
