JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-01-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 406, 420, 467, 468 and 120(B) of the Indian Penal Code in connection with Begusarai Town P.S. Case No. 519/2015.
It has been submitted on behalf of the petitioner that the allegation against the petitioner is that by creating forged document he got the informant relieved from the post of director and thus, committing fraud misappropriated 20% share amount of the informant, but the sources of invested amount has not been mentioned by the informant.
Heard learned Additional Public Prosecutor also as well as learned counsel for the informant. They have opposed the prayer of anticipatory bail on the ground that the petitioner has created forged
Patna High Court Cr.Misc. No.13291 of 2016 (14) dt.20-01-2017 2/2 document stating that the informant has resigned from the post of the director and also made documents without knowledge of the informant that he is forgoing his 20% share in the company, but there was no such things.
Having heard both sides, in view of the facts aforesaid and nature of allegation made against the petitioner, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of six weeks, be released on provisional bail, till submission of charge-sheet, on furnishing bail bond of Rs. 25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai, in connection with Begusarai Town P.S. Case No. 519/2015, with condition that one of the bailors should be local one and another having sufficient immovable property within the territorial jurisdiction of the court concerned and once charge-sheet is submitted, the petitioner may surrender before the court below and make prayer for regular bail. The court below, considering the materials available in the case diary, will pass appropriate order.
With the aforesaid observation, this application is disposed of.
