The petitioner seeks regular bail in connection with K. Nagar P.S. Case No. 109 of 2014 for the offence registered under Section 366A and other allied sections of the Indian Penal Code.

The mother of the informant made allegation that the petitioner and his brother-in-law, namely, Dhiraj Ram kidnapped her daughter Arti Kumari for the purpose of

Patna High Court Cr.Misc. No.34427 of 2014 (3) dt.13-01-2015 2/2 marriage. The victim was recovered and made her statement under Section 164 Cr.P.C. that the petitioner and Dhiraj Ram enticed her and Dhiraj Ram forcibly solemnized marriage with her.

It is submitted on behalf of the petitioner that Aarti Kumari is still living with Dhiraj Kumar as husband and wife. Considering the facts that the victim did not make any allegation against the petitioner, except that the petitioner also enticed her and for that petitioner is in jail custody since 21.03.2014, petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Purnea in connection with K.Nagar P.S. Case No. 109 of 2014.
