Petitioner apprehends his arrest in Kothi P.S. Case No.9 of 2019, registered under Section 30(a) of the Bihar Prohibition and Excise Act.
The informant alleged that during the course of patrolling, the informant saw a person taking something in a bag. When the informant asked him to stop, he fled away after leaving the motorcycle and 20 litres of country made liquor was recovered.
Learned counsel for the petitioner submits that the petitioner is neither the owner of the vehicle nor anything was recovered from possession of the petitioner. Petitioner was not driving the motorcycle and he has no manner of concern with
Patna High Court CR. MISC. No.33115 of 2019(2) dt.20-05-2019 2/2 the seized article. Petitioner has not filed any petition for release of the motorcycle.
Taking into consideration the facts aforesaid, let petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Gaya in connection with Kothi P.S. Case No.9 of 2019, subject to the conditions laid down under Section 438(2) Cr.P.C.
