====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 24-07-2026 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in connection with Shahpur P.S. Case No. 29 of 2026, instituted under Sections 191(2), 191(3), 190, 126(2), 115(2), 352, 109 and 117(2) of the B.N.S.

3. As per the prosecution case, on the alleged date of occurrence, when the informant along with his cousin brother went to his field which is half k.m. away from his house, then the petitioner (Rohit Singh) along with co-accused persons, namely, Shivam Singh, Kamlesh Singh, Ishwant Singh, Piyush Singh and Tinku Singh, overpowered him holding lathi and iron rod and started abusing him. After the alleged occurrence, he was admitted to Government Hospital at Shahpur and after doctor's reference, he was transferred to Sadar Hospital at Ara, where his treatment was going on.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case due to village politics. Co-villager Tej Narayan Singh had lodged two cases against the family member of the informant and, thereafter, the informant has lodged this case against the accused persons including the present petitioner, in which, other accused persons have already been granted anticipatory bail by the learned Court concerned. He further submits that, being the co-villagers, both the parties have compromised and filed compromised petition in the Court concerned. A copy of the compromise petition is also annexed with this petition as "Annexure-P4". The informant sustained fracture injury on his hand, but that is not on the vital part of the injured. He next submits that there is no chance of absconding of the petitioner or tampering with the evidence. Petitioner is having no criminal antecedent and he undertakes to cooperate in the trial and investigation.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

6. Considering the facts and circumstances of the case, submission of learned counsel for the parties and clean antecedent of the petitioner, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Court of Additional Chief Judicial Magistrate-I, Bhojpur at Ara/concerned Court in connection with Shahpur P.S. Case No. 29 of 2026, subject to the conditions laid down in Section 482 (2) of the Bharatiya Nagrik Suraksha Sanhita (B.N.S.S.), 2023.
