JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 09-12-2020 In view of the submission and the undertaking of the learned counsel for the petitioner, at the time of hearing of this application through video conferencing, that he would remove the defect(s), as pointed out by the office vide its notes dated 24.11.2020, within two weeks of starting of the Court proceeding in physical mode, he is permitted to remove the same accordingly.

Heard learned counsel for the petitioner and the learned A.P.P. for the State through video conferencing. The petitioner seeks bail in connection with Sonbarsa P.S. Case No. 95 of 2020, registered under Sections 336 and 418 of the Indian Penal Code and 18 (C), 27(b)(ii), 18A/28 of the N.D.P.S.Act.

The accusation is that Ramesh Kumar @ Nanki,

Patna High Court CR. MISC. No.31741 of 2020(2) dt.09-12-2020 2/2 neighbour of informant Shym Kumar came at his house at about 8.00 A.M. on 17.05.2020 and started pelting stones and bricks at his house giving threatening to kill him. The informant, anyhow, saved himself from pelting stones by the petitioner. In the meantime, his neighbours caught hold petitioner and from his possession six bottles corex syrup, each containing 100 ML, recovered.

Learned counsel appearing for the petitioner submits that petitioner has falsely been implicated in this case due to dirty village politics. Further submission is that while petitioner is accused in four cases, as detailed in paragraph-3, but in all cases he is on bail, which have been lodged at the instance of the informant of the present case. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the 1st Addl. Sessions Judge, Sitamarhi in connection with Sonbarsa P.S. Case No. 95 of 2020. (Rajendra Kumar Mishra, J) manish/- U T
