29-10-2021 Heard learned counsel for the parties through video conferencing.

The petitioner seeks bail in Ara Town P.S. Case No. 201 of 2021, registered for the offence under Sections 25(1B)AA/26/35 of the Arms Act. On a secret information, a raid was conducted and this petitioner alongwith co-accused Bir Kumar was arrested and on search, one country-made automatic carbine with Magazine wrapped in a plastic bag was recovered from the possession of co-accused Bir Kumar.

So far as this petitioner is concerned, no arms or ammunition has been recovered. Petitioner has got clean antecedent and he is in custody since 06.03.2021.

Patna High Court CR. MISC. No.42958 of 2021(2) dt.29-10-2021 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the period of custody and the fact that no arms or ammunition has been recovered from the possession of petitioner, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bhojpur, Ara in connection with Ara Town P.S.
