The petitioner has filed the instant application for grant of regular bail in connection with Chautham P.S. Case No. 246 of 2021 registered under sections 147, 148, 149, 341, 323, 308, 385 and 386 of the Indian Penal Code.
Allegation against the petitioner along with other co-accused persons is that they abused and assaulted the informant by means of lathi, danda and weapon due to which he sustained injury. Further, the main reason of this alleged occurrence was rangdari of
Patna High Court CR. MISC. No.35024 of 2024(2) dt.16-05-2024 2/3 one lakh which was being demanded by the accused persons from him.
Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case due to previous enmity and village politics. It is further submitted that the injury of the informant is simple in nature caused by hard and blunt substance. The injury report has been brought on record as Annexure-P-2 of this petition. There is a case and counter case and both parties have sustained injuries as alleged in separate occurrence. Further the allegation of rangdari from the informant is false and fabricated. Nothing cogent material came against the petitioner to implicate in this case. He is languishing in judicial custody since 01.06.2023.
The application for bail is opposed by learned APP for the State.
Having heard learned counsel for the parties
Patna High Court CR. MISC. No.35024 of 2024(2) dt.16-05-2024 3/3 and taking into consideration the facts and circumstances of the case as well as the custody of the petitioner, the Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Chautham P.S. Case No. 246 of 2021 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria.
