2. A prayer for bail has been made on behalf of the petitioner in connection with Begusarai Mufassil P.S. Case No.313 of 2023 registered for the offence under sections 366A and 34 of the Indian Penal Code.

3. As per prosecution case, the informant states that her daughter was allured by the petitioner who was the neighbour and she had apprehension that some harm could be done to his daughter.

4. Learned counsel for the petitioner submits at the outset that there is a delay of 11 days in institution of the F.I.R inasmuch as date of occurrence is 19.05.2023 whereas F.I.R was

Patna High Court CR. MISC. No.32216 of 2025(2) dt.20-05-2025 2/3 lodged on 01.06.2023. As a matter of fact both the parties are the neighbours as admitted in the F.I.R itself and the petitioner and the daughter of the informant who is aged about 20 years were in a love relationship and even got married and a child has also been born out of their wedlock on 10.08.2024. A supplementary affidavit has also been filed on behalf of the petitioner, bringing on record which has been sworn by the victim herself, stating therein that she is voluntarily married with the petitioner and has also blessed with a child. She was earlier forced to give the statement under Section 161 and 164 of the Cr.P.C against the petitioner. However, she is living with her child with the family of the petitioner. Learned counsel for the petitioner further submits that the victim had also filed a complaint case before the learned Chief Judicial Magistrate, Bathinda against the husband of the informant complaining that the victim was being compelled to marry an old man. The petitioner has no criminal antecedent.

5. The application for bail is opposed by learned APP for the State.

6.Taking into consideration entire facts and circumstances of the case as also the petitioner has no criminal antecedent, the petitioner is directed to be enlarged on bail in

Patna High Court CR. MISC. No.32216 of 2025(2) dt.20-05-2025 3/3 connection with Begusarai Mufassil P.S. Case No.313 of 2023 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M, Begusarai.
