The petitioner seeks bail in connection with Nayagaon P.S. Case No. 03 of 2020 dated 15.01.2020 instituted for the offence under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act. The deceased is the brother of the informant who has been shot dead because of his supporting the marriage of the son of the informant with one Munmun Kumari for which a Panchayati was held. Though the act of killing the deceased is not specifically attributed to the petitioner but he is alleged to have caught hold of the deceased when he was shot at by another accused person. Some other accused persons are also alleged to
Patna High Court CR. MISC. No.31400 of 2020(2) dt.03-12-2020 2/2 have caught hold of the deceased before he was shot dead including Deepak Jha and Pramod Jha. Both the aforesaid persons have been granted bail vide Cr. Misc. No. 25758 of 2020 and Cr. Misc. No. 23719 of 2020. The petitioner is in custody since 17.01.2020 and has clean antecedents.
Considering the aforestated facts, the petitioner is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st, Begusarai in connection with Nayagaon P.S.
