2. The petitioner apprehends arrest in connection with Amnour PS Case No. 229 of 2025 dated 28.07.2025, instituted under Sections 30(a), 47 of the Bihar Prohibition and Excise Amendment Act.

3. The allegation is of recovery of 67.500 liters of foreign liquor from Brezza vehicle bearing registration no. BR01DR-8626 and co-accused Rahul Kumar was also arrested at spot.

4. Learned counsel for the petitioner submits that nothing has been recovered from the conscious possession of the petitioner, rather, the illicit liquor has been recovered from the car and the petitioner has no concern with the car. Only on

Patna High Court CR. MISC. No.32639 of 2026(2) dt.13-05-2026 2/3 the basis of disclosure made by the co-accused, Rahul Kumar, the petitioner has been made accused in this case. Lastly, it is submitted that the petitioner has four criminal cases against him.

5. Learned APP has opposed the prayer for bail.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-cum-Exclusive Special Court Excise Act-1, Saran at Chapra, in Amnour PS Case No.

No.32639 of 2026(2) dt.13-05-2026 3/3 nature after his release in the present case and thereafter the court below will be at liberty to initiate the proceeding for cancellation of bail on ground of misuse, (iv) that if the petitioner tampers with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail and (v) that the petitioner within two weeks from the date of his furnishing bail bond shall appear before the SHO of his local area along with a copy of this order and thereafter shall appear before him every fortnightly to mark his attendance till the conclusion of trial.

7. The application stands allowed.
