Earlier prayer for bail of the petitioner was rejected by this court vide order dated 23-04-2014 passed in Cr. Misc. No. 5308 of 2014 but admittedly, the petitioner is in jail custody since 31-10-2013 and he does not have any criminal antecedent. From perusal of the report of Ad hoc Additional Sessions Judge-IV, Araria, it would appear that uptill now, charge could not be framed against the petitioner and almost all the other accused persons have already been granted privilege of bail. Considering the aforesaid facts and circumstances of the case as well as submission of the parties, as also the period of detention of the petitioner in jail custody, let the petitioner, named above, be released on bail on furnishing bail bond of Rs 10,000/-
