JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 05-08-2022 This writ application has been filed seeking a direction to the respondent authorities to produce the case records of Rupauli P.S. Case No. 20 of 1990 registered for the offences under Section 409 of the Indian Penal Code along with the final report submitted by the Police vide Final Report No. 13 of 2013 in respect to the petitioner.

Earlier on 05.07.2022, this Court passed the following order:- "It appears on perusal of Annexure-B to the counter affidavit filed on behalf of the respondent no. 7 that learned Chief Judicial Magistrate, Purnea was taking steps to get the carbon copy of

Patna High Court CR. WJC No.1196 of 2016(4) dt.05-08-2022 2/2 all necessary documents for reconstruction of the lower court records of G.R. No. 266/1990.

Call for a report from the court of learned Chief Judicial Magistrate, Purnea. He will inform this Court whether the records have been reconstructed and final form said to have been submitted by the police in the present case has been accepted or not.

List this matter under the same heading maintaining its position on 4th of August, 2022." Today, Mr. Satyabir Bharti, learned counsel representing the Civil Court, Purnea has informed this Court that the records have been found in the civil court and the learned C.J.M., Purnea had informed him that within the shortest possible time he will pass an appropriate order. Since the records are now available, the petitioner may inspect the same in accordance with law.

Learned C.J.M., Purnea shall pass an appropriate order within three weeks from the date of communication of this order.

This writ application stands disposed of accordingly. Mr. Iqbal Asif Niazi, learned AC to GP-5 for the State is present.
