The petitioner, who is in custody since 10.06.2020, seeks bail in connection with Madhepura P.S. Case No. 440 of 2020 dated 09.06.2020 instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018. Approximately 3374 litres of liquor is said to have been recovered from a vehicle of which the petitioner is stated to be the driver.

Learned counsel for the petitioner has submitted that he is a person of clean antecedent and did not know that the consignor had loaded prohibited articles also along with other consignment.

Regard being had to the fact that the petitioner

No.31318 of 2020(2) dt.01-12-2020 2/2 has clean antecedent and is in custody since 10.06.2020, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, Madhepura in connection with Madhepura P.S. Case No. 440 of 2020.
