JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 24-02-2020 Learned counsel for the State has drawn the attention of this Court towards the statements made in Paragraph '8' and '12' of the counter affidavit. WJC No.1137 of 2016(4) dt.24-02-2020 2/2 drawn towards the statement made in Paragraph '5' of the supplementary counter affidavit giving an impression to this Court that the I.O. of the case is investigating the matter and has taken appropriate steps in the court of learned A.C.J.M. XIII on various dates for issuance of warrant of arrest and process against absconding accused Feroz Ahmad who is reported to be in Haryana. The court has also been informed that process under Section 82 Cr.P.C. has been taken against the absconding accused.

At this stage, instead of keeping the writ application pending it is being disposed off with a direction to the Superintendent of Police, Siwan (Respondent No. 4) to supervise the investigation of the case, ensure that the process issued by the learned court below be duly executed without further delay and an appropriate police final report be filed in this case within a period of 90 days from the date of receipt/production of a copy of this order.
