JUSTICE ASHUTOSH KUMAR ORAL ORDER 12-01-2021 Heard Mr. Shashi Dhar Jha, learned counsel for the petitioner and learned APP for the State. The petitioner, who is the husband of the deceased seeks bail in connection with Baliya P.S. Case No. 104 of 2018 instituted for the offences under Sections 304(B)/34 of the Indian Penal Code.

The deceased was done to death while the matrimonial relationship between the spouses existed. The petitioner is said to be in custody since 19.03.2020.

Considering the nature of accusation against the petitioner, I am not inclined to grant bail to him for the

Patna High Court CR. MISC. No.31408 of 2020(3) dt.12-01-2021 2/2 present.

The prayer for bail is rejected.

However, if there is no substantial progress in trial within the next one year, the petitioner would be at liberty to approach the Trial Court for grant of bail and in that event, the Trial Court would be required to state the reasons for tardy progress of trial.
