2. The petitioner apprehends his arrest in connection with Kundwachainpur P.S. Case No. 226 of 2024 for the offence registered under Sections 30 (a) of the Bihar Prohibition & Excise Amendment Act.
3. As per the prosecution case, there is recovery of 135 litres of illicit Nepali Country made liquor from the field of Sri Ram Singh. The allegation against the petitioner is that he fled away from the spot.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case on the basis of suspicion. The petitioner was not present at
Patna High Court CR. MISC. No.27801 of 2025(2) dt.21-05-2025 2/2 the spot and no incriminating material recovered from the conscious possession of the petitioner. The place of recovery is an open place accessible to the public at large. Petitioner has no concern with the place of recovery and the seized liquor. Petitioner has no criminal antecedent and he undertakes to cooperate in the investigation and trial of this case.
5. Learned APP opposes the prayer for anticipatory bail of the petitioner.

Considering the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the concerned Court where the case is pending in connection with Kundwachainpur P.S. Case No. 226 of 2024, subject to the conditions as laid down under Section 482 (2) of the B.N.S.S. (Sunil Dutta Mishra, J) khushbu/- U T
