28-10-2021 Heard learned counsel for the parties.
Earlier, the bail petition of petitioner and two coaccused was rejected by this Court, vide order dated 06.10.2020 passed in Cr.Misc. No. 9687 of 2020 (Annexure-1). It is submitted on behalf of petitioner that as per F.I.R. itself, specific allegation of firing is against other co-accused persons namely Ramesh Yadav, Guddu Yadav, Abeen Yadav and Jai Chandra Yadav. There is general and omnibus allegation of firing against all the accused persons including this petitioner. Other similarly situated co-accused persons namely Bhemeshwar Prasad, Uday Yadav, Pappu Yadav and Saini Yadav have already been granted bail by this Court, vide orders annexed as Annexure 5 and Annexure 6 series respectively. Charges have already been framed against petitioner and others on 09.12.2020. Petitioner has got clean antecedent and he is in
Patna High Court CR. MISC. No.42928 of 2021(2) dt.28-10-2021 2/2 custody since 04.09.2019.
Learned A.P.P. for the State has opposed the bail petition.
Considering the period of custody and the fact that other similarly situated co-accused persons have been granted bail, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Fast Track Court, Saharsa / concerned court in connection with S.Tr.No. 70 of 2020, arising out of Salkhua P.S. Case No. 203 of 2019.
