Learned Counsel for the petitioner is directed to remove the defect(s), as pointed out by the office, within a period of four weeks.

The petitioner seeks bail in a case registered under Section 414 of the Indian Penal Code and Sections 25(1b)a/26/35 of the Arms Act. Allegation is that two country made pistols and live cartridges are recovered from the petitioner. It has been submitted on behalf of the petitioner that the petitioner is in custody since 20.10.2021. Charge sheet has been submitted in the present case. There is no allegation of tampering of witnesses alleged against the petitioner. The

Patna High Court CR. MISC. No.32669 of 2022(3) dt.21-12-2022 2/2 petitioner has falsely been implicated in the present case. It is alleged that two country made pistols and live cartridges are recovered from the petitioner. There is no compliance of Section 100 Cr.P.C.

On behalf of the State, it is submitted that the petitioner is named in the complaint case/F.I.R. Considering the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Vaishali at Hajipur in connection with Hajipur Town P.S. case No.840/21.

The petitioner is directed to co-operate during the trial. If the court below finds that the petitioner is not cooperating during the trial, the court below will be at liberty to cancel the bail bond of the petitioner.
