The petitioner seeks regular bail in connection with Jhajha P.S. Case No. 398 of 2020, registered under Sections 147, 148, 149, 341, 323, 324, 325, 504, 506 and 302 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is in custody since 20.03.2021, and is a person of clean antecedent and charge-sheet has been submitted, allegation as alleged in the F.I.R., it would manifest that it was Beni Mandal who assaulted Ghanshyam Mandal (deceased) who died and also assaulted Gopal Mandal, as far as this petitioner is concerned it is alleged that he was also present at the place of occurrence with weapon in his hand, no specific

Learned APP for the State vehemently opposes the prayer of regular bail application of the petitioner and submits that petitioner was also present at the place of occurrence with weapon but is not able to meet the submission of learned counsel for the petitioner that no overt act has been alleged against him except that he was also present at the place of occurrence.

Considering the fact that the petitioner is in custody since 20.03.2021, charge-sheet has been submitted in this case and no specific overt act has been alleged against him and the petitioner, is a person with clean antecedent, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui in connection with Jhajha P.S. Case No. 398/2020.
