1. Heard the parties

2. The petitioner seeks regular bail in connection with Sessions Trial No. 826 of 2025 arising out of Samastipur Rail P. S. Case No. 198 of 2025 registered for the offences punishable under Sections 305(c), 304(2) and 317(2) of the BNS and later on cognizance has been taken under Sections 305 (c), 304(2), 317(2) and 317(4) of the BNS.

3. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is submitted that nothing has been recovered from the conscious possession of the petitioner and he has been implicated merely due to altercation which took place between the informant and the petitioner on the railway platform. Learned counsel further submits that the petitioner was neither

It is also submitted that the petitioner belongs to a poor family and is in custody since 13.10.2025 and except the alleged antecedents, details whereof are not available, there is no material against the petitioner.

4. Learned APP appearing for the State has opposed the bail prayer of the petitioner.

In the facts and circumstances of this case and considering the statements made in the petition as well as above submissions, coupled with the nature of accusation, petitioner's custody period and completion of investigation against him, this court is inclined to enlarge the petitioner on bail, accordingly, let the petitioner named-above be enlarged on bail in connection with Sessions Trial No. 826 of 2025 arising out of Samastipur Rail P. S. Case No. 198 of 2025 on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned.
