JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 03-01-2022 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 376(D)(B) and some other ancillary Sections of the Indian Penal Code, u/s 3,4,5,6,7 & 8 of Immoral Trafficking Act, u/s 4, 17 of POCSO Act and u/s 75, 81 of J. J. Act.

As per the prosecution case, co-accused Mala Devi took the informant and her mother to her house and gave them food to eat and after consuming the same they became unconscious and when they regained consciousness they found themselves in an unknown room where sex racket was running. It is further alleged that owner of house is this petitioner. Learned counsel appearing for the petitioner submits

Patna High Court CR. MISC. No.42159 of 2021(2) dt.03-01-2022 2/2 that petitioner is innocent and has falsely been implicated in the case. Specific allegation as per FIR is against other accused persons. Petitioner has no role in the occurrence and she has been made accused only because she is daughter of co-accused, Suresh Giri. Co-accused, Mala Devi has already been granted bail by a co-ordinate Bench of this court vide order passed in Cr. Misc. No. 29261/2021. Petitioner claims clean antecedent and is in custody since 19.12.2020 and investigation in this case is complete.

Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-VI-cum- Special Judge, POCSO Act, West Champaran, Bettiah in connection with Bettiah (Mahila) PS case No.29/2020.
