JUSTICE MOHIT KUMAR SHAH ORAL ORDER 31-10-2018 The present application has been filed for modifying the order dated 27.02.2018 passed in Criminal Misc. No. 10113 of 2018, whereby and where under though the petitioner was granted anticipatory bail and he was directed to surrender within a period of six weeks from the date of receipt/production of a copy of the order, however the petitioner could not surrender within the stipulated time on account of the reasons mentioned in the present petition, hence a prayer is made to extend the time granted to surrender.

The learned Additional P.P. Shri Ashok Kumar, appearing for the State, has no objection.

Having regard to the facts and circumstances of the case as also the reasons mentioned in the present petition, the present modification petition is allowed and the petitioner is granted liberty to surrender within a period of four weeks from today, whereupon he shall be released on anticipatory bail subject to the conditions mentioned in the earlier order dated 27.02.2018.
