This application for grant of regular bail arises out of Siwaipatti P.S. Case No.45/2019, registered for the offence punishable under Section 394 of the Indian Penal Code. The petitioner's prayer for regular bail was earlier rejected by an order dated 19.06.2020 passed in Cr. Misc. Nos. 1940 of 2020 and 9866 of 2020 and subsequently by an order dated 22.09.2021 passed in Cr. Misc. No. 41776 of 2021 considering the nature of accusation and his criminal antecedents.

In compliance of this Court's order, a report has been received from the court of learned Judicial Magistrate-1st Class, Muzaffarpur (East), from which it transpires that charge has been framed on 14.02.2020 against the petitioner and the case is

Patna High Court CR. MISC. No.33423 of 2022(3) dt.10-08-2022 2/2 running for evidence.

Considering the petitioner's long history of criminal cases pending against him, I am not inclined to grant him privilege of bail for the present.

The court below is, however, directed to take all possible steps to expedite trial and conclude the same, if possible within a period of six months from the date of communication of the present order.

If there is no progress at all at the trial, the petitioner shall be at liberty to renew his prayer for bail thereafter. (Chakradhari Sharan Singh, J) Pawan/- U T
