2. The present application has been filed seeking recall of the order dated 28.02.2017 passed in C.W.J.C. No. 12386 of 2010 by which the writ petition was dismissed for non-prosecution.

3. Learned counsel for the petitioner submitted that due to inadvertence, the case could not be marked and thus, nobody appeared when the case was taken leading to its dismissal.

4. Having heard to the learned counsel for the parties and going through the averments made in the petition, the Court finds that sufficient cause has been shown for non-appearance of the learned counsel for the petitioner on 28.02.2017 when C.W.J.C. No. 12386 of 2010 was taken up leading to its dismissal.

5. In the aforesaid background, the order dated 28.02.2017 passed in C.W.J.C. No. 12386 of 2010, stands recalled and the same stands restored to its original file and number.

6. The petition stands disposed of in the aforementioned terms.
