The petitioner seeks bail in connection with Chiraiya P.S. Case No. 224 of 2020 dated 31.07.2020 instituted for the offences under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act.

It appears from the prosecution report that 84.690 litres of country made liquor was recovered from a jute bag which was being carried by the petitioner on his motorcycle.

Learned counsel for the petitioner has submitted that the recovery has wrongly been shown against the petitioner.

Patna High Court CR. MISC. No.31430 of 2020(2) dt.03-12-2020 2/2 The petitioner is a person of clean antecedents and is in custody since 31.07.2020.

Regard being had to the facts of this case, the petitioner is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Motihari, East Champaran in connection with Chiraiya P.S. Case No. 224 of 2020.
