In this case, the petitioner is seeking anticipatory bail in connection with Sitamarhi (Punaura O.P.) P.S. Case No.474 of 2018 registered for offence punishable under sections 272, 273 of the Indian Penal Code and section 30 (A) of the Bihar Prohibition and Excise Act, 2016. It has been alleged that 39 litres of Nepali liquor has been recovered. The petitioner has criminal history of similar nature.

Looking to the facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner and accordingly his prayer for bail is rejected. However, if the petitioner surrenders and prays for regular bail, the court below
