2. The petitioners seek anticipatory bail in connection with Kalyanpur P.S. Case No. 70 of 2023 registered for the offence punishable under Sections 341, 323, 338, 379, 307, 504/506 and 34 of the Indian Penal Code.

3. As per the prosecution case, the petitioners are said to have assaulted the victim and have taken away Rs. 12,000/-.

4. At the outset, learned counsel for the petitioners without accepting the guilt of the petitioners has submitted that the petitioners are ready to compensate the informant by paying

Patna High Court CR. MISC. No.35206 of 2024(2) dt.21-06-2024 2/2 an amount of Rs. 10,000/- each as medical assistance.

5. Learned APP appearing for the State opposes the prayer for regular bail of the petitioners.

6. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the J.M. 1st Class, Samastipur in connection with Kalyanpur P.S. Case No. 70 of 2023, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973.

7. At the time of furnishing the bail bonds, the petitioners shall furnish a demand draft of Rs. 10,000/- (Ten Thousand) each prepared in the name of the informant. If the petitioners furnish the demand draft of Rs. 10,000/-, the Court below shall accept the bail bonds of the petitioners and hand over the said demand draft to the informant.
