====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 27-06-2019 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is languishing in custody since 12.01.2019 in a case for the offence registered under Sections 420, 406/34 of the IPC and 66 of the Information Technology Act.

The prosecution story, in brief, is that the accused persons by playing fraudulent, Rs. 33,000/- was withdrawn from the bank account of nephew of the informant.

It has been submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in the present case. Charge sheet has been submitted in the present case. The petitioner is not named in the F.I.R. There is no

Patna High Court CR. MISC. No.36769 of 2019(2) dt.27-06-2019 2/2 allegation of tampering with the witnesses alleged against the petitioner. There is no substantive evidence to suggest the implication of the petitioner in the present case. It is further submitted that the petitioner is ready to deposit an amount of Rs. 10,000/- (Ten Thousand) in the learned court below which shall be subject to final disposal of the case.

On behalf of the learned counsel for the State, it has been submitted that the petitioner is not named in the F.I.R. Considering the aforesaid facts and circumstances, it is directed that the petitioner shall deposit an amount of Rs. 10,000/- (Ten Thousand) in the learned court below which shall be subject to final disposal of the case. On doing so, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Saran, Chapra, in connection with Dighwara P.S. Case No. 257 of 2018.
