The petitioner is apprehending his arrest in connection with Bakhari P.S. Case No.85 of 2017 giving rise to G.R. No.1221 of 2017 for allegedly having committed the offence under Sections 409, 467, 468, 471 and 120B of the Indian Penal Code.

Learned counsel for the petitioner submits that though the allegation against the present petitioner is that he committed forgery, after due investigation it was found that no forgery had been committed and accordingly, final form was not submitted against the petitioner. However, learned

No.65987 of 2018(2) dt.19-12-2018 2/2 C.J.M. on the basis of protest petition has taken cognizance of the offence against the petitioner, which has necessitated him to file the present application for anticipatory bail. Considering the aforementioned facts and circumstances and that earlier charge sheet had not been submitted against the petitioner and that initial investigation did not reveal the involvement of the present petitioner, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-V, Begusarai, in connection with Bakhari P.S. Case No.85 of 2017 giving rise to G.R. No.1221 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
